Notice of the Ministry of Natural Resources Office on the Selection of Green Mines in 2020

 

 

Natural Resources Office Letter [2020] No. 839

 

   Natural resources authorities of all provinces, autonomous regions, and municipalities directly under the Central Government:

 

   In order to continuously and orderly promote the construction of green mines, the following matters concerning the selection of green mines in 2020 are hereby notified:

I. Selection Principles

 

   (1) Selection basis. The "Implementation Opinions on Accelerating the Construction of Green Mines" (Guotuzi Gui [2017] No. 4) and 9 industry standards, including the "Green Mine Construction Standard for Non-metallic Mineral Industry".

 

   (2) Scope of selection. Independent mines (including oil and gas) with valid mining licenses and in normal operation, which have not been subject to administrative penalties from natural resources and ecological environment departments in the past three years, or have been subject to administrative penalties but have completed rectification. During the selection period, they have not been included in the abnormal list of the mineral rights holders' exploration and mining information disclosure system. The mining area does not involve any nature reserves. The remaining recoverable reserves of the mine should be sufficient for at least three years.

 

   (3) Number of selections. Emphasizing the typicality and representativeness of mining enterprises, the number of selections in each province (region, city) should generally not exceed 10.

 

II. Selection Procedures

 

   (1) Online application. Starting from June 1, 2020, mining enterprises will be organized to log in to the National Green Mine List Management Information System (hereinafter referred to as the List System) to fill in relevant application information.

 

   (2) Mine self-assessment. Organize mining enterprises that have passed the online application to conduct self-assessment according to the requirements for green mine construction and industry standards, form a self-assessment report, and fill it in the List System.

 

   (3) Third-party assessment. Entrust a third-party assessment agency to conduct on-site assessment of the mine through government procurement services, and form a third-party assessment report according to unified evaluation indicators.

 

   (4) Material review. Review self-assessment reports, third-party assessment reports, and other materials.

 

   (5) On-site verification. Conduct on-site verification of all mines that have passed the third-party assessment through various methods such as open and secret visits and document review.

 

   (6) Publicity. Publicize the selection and recommendation results within the province (region, city) through the Internet, newspapers, and other channels.

 

III. Work Requirements

 

   (1) Careful organization. Local authorities should strengthen organizational leadership and financial support, coordinate the selection and recommendation work during the COVID-19 epidemic prevention and control period, strictly follow work procedures, unify evaluation standards, be true and realistic, and ensure openness, fairness, and justice. Effectively reduce the burden on enterprises and reduce the submission of materials. Self-assessment reports and third-party assessment reports are all filled in the List System and do not need to be submitted in paper form.

 

   (2) Strengthen the responsibility mechanism of third-party assessment agencies. Local authorities should strengthen supervision and promote the standardization of assessment work. The assessment agency should be an enterprise, institution, social organization with independent legal person qualifications, or a relevant professional assessment agency that has been recognized. The assessment agency and assessment experts must maintain independence from the mining enterprise and must not participate in the preparation of the mine's self-assessment report. They must not have any related business dealings with the mining enterprise within one year before and after the assessment work. It is strictly prohibited to collect fees from mining enterprises in any form or to use the assessment to seek improper benefits. For those with serious violations such as falsification and favoritism, they will be reported and their assessment reports will not be accepted.

 

   (3) Strictly conduct on-site inspections. Local authorities should do a good job in daily supervision, and according to the requirements of "double random, one public", conduct on-site inspections of mines that have been included in the national green mine list. For mines that do not meet the standards, they should be reported in a timely manner and removed from the list system. Relevant work can be carried out simultaneously with the on-site verification of the mineral rights holders' exploration and mining information disclosure, giving play to the role of social supervision, and gradually building a green mine credit system.

 

   Please complete the selection by September 30 and report the selection and recommendation list and the on-site inspection situation to the Mineral Resources Protection and Supervision Department of the Ministry. The Ministry will conduct a review through on-site inspection or online verification, video and photo verification, etc., according to the epidemic prevention and control situation. For mines that meet the relevant standards, they will be included in the national green mine list after being announced to the public.
